I apologize if this has already been posted, I have not had a chance
to keep up with the group due to a busy travel schedule.

But for those of you who might not know, looks like there was a class
action settlement that probably pertains to a lot of builders, I
know my craftsman compressor was in it so hopefully I'll get the $50
gift card or whatever it is:

Thanks for the compressor litigation info. Mine is a Craftsman also and I submitted my claim.

This is ridiculous. I hate to rant here (rarely would I ever post
about this), but if the thing works good and serves your purpose then
this just seems wrong. Perhaps this is why stuff costs SO much in
the first place...

Well, a lie is a lie is a lie. The manufacturer's shouldn't lie and
in my book just because a product works satisfactorily doesn't
justify telling a lie to sell it. I can't imagine that my 5 HP
compressor wouldn't be MORE satisfactory to me if it was rated at 5
HP continuous not 5 HP peak. Some punitive damages seem appropriate
to me to discourage this type of disception.

As for this adding to the cost of the product, I'm not convinced it
really does. It's the ***attitude*** that resulted in the lie that
may raise the price. No one forced any of those companies to
exaggerate their claims. They freely choose to do it. A $50 gift
certificate probably costs the manufacturer $20 and they can absorb
more than that in the price of $350-$400 compressors.

Rant on if you feel the need but I will be very cautious dealing
with these companies in the future. They've lied to me. Fool me
once, shame on you. Fool me twice shame on me. This buyer will
beware and wary in the future. I think the settlement was too cheap.

I totally agree!
I have a small Porter Cable compressor that falls into the Devilbiss
part of the settlement yet the motor name plate plainly states 4 HP
Peak.
I don't see where this is misleading. If the consumer is so ignorant
as to not know the difference between peak and continuous ratings then
I say too bad.
This seems not too different from the Carnahan case in Missouri where
Parker Hannifin is forced to pay $4,000,000 to the Governors family
even though there was absolutley no evidence of vacuum pump failure in
the crash. In fact, the evidence was to the contrary. This was a case
where the Jury was too ignorant of technological arguments and
succumbed to a smooth argument from an ambulance chaser.
The end result is another aircraft equipment manufacturer bailing
because they can't risk their deep pockets anymore.
No one wants to take responsibility for their own protection anymore!

Enough of this! I could go on but I know this is not what anyone wants
to read here and I apologize for the interruption. This type of
frivolous lawsuit just trips my button.
